Terms of Use for In-home Postnatal Care Service

These Terms of Use (“Terms”) set forth the conditions for using the In-home Pre and Postnatal Care Service (“Service”) provided by Namukasa Midwifery (“Provider”). By applying for this Service, the user (“User”) is deemed to have agreed to these Terms.
Article 1: Scope of Application
These Terms apply to all relationships between the Provider and any User of the Service. Additional guidelines and notices presented separately on the Provider’s website or similar platforms shall be considered part of these Terms.
Article 2: Description of Services
The Service is provided at the User’s residence for the purpose of supporting physical and mental recovery after childbirth and childcare assistance. Services include:
- Health checks for the mother (e.g., monitoring blood pressure and temperature)
- Breastfeeding consultation, guidance, and hands-on support (including latch-on techniques)
- Initial response to breast issues (collaboration with medical institutions if needed)
- Newborn care (e.g., bathing assistance, weight checks)
- Childcare, lifestyle consultation, and mental health support
Services are provided by qualified professionals recognized by the Provider, such as midwives, nurses, and IBCLCs (“Care Providers”). If medical care is deemed necessary, Users will be advised to seek appropriate medical treatment in collaboration with healthcare institutions.
Article 3: Eligible Users
The Service is intended for mothers and their babies within one year after childbirth. When using the Nagoya City subsidized postnatal care program “Nagoya Mommy Care⁺” (“Subsidy Program”), eligibility and operations will follow the program’s guidelines.
Article 4: Application and Contract Formation
Applications must be made using methods designated by the Provider (e.g., website, phone, email). The service contract is deemed concluded once the Provider accepts the application and notifies the User
Article 5: Fees and Payment
Service fees are as listed on the Provider’s website. Fees under the Subsidy Program are calculated based on Nagoya City regulations (e.g., the standard out-of-pocket cost per visit is 1,560 yen; zero for households exempt from city tax or on public assistance). Fees may be subject to change due to revisions in regulations.
Payment methods are as specified by the Provider (e.g., cash on the day, bank transfer). When using the Subsidy Program, Users must submit relevant vouchers as required.
Article 6: Changes and Cancellations
Users must contact the Provider by noon the day before to change or cancel a reservation. If the deadline is missed:
- Under the Subsidy Program: A cancellation fee of 1,560 yen per visit applies (per Nagoya City regulations).
- Outside the Subsidy Program: Two-thirds of the service fee will be charged as a cancellation fee, and the remainder will be refunded to the User’s designated account (transfer fees borne by the User).
No-shows without notice are treated the same. Exceptions may apply in cases of natural disasters, traffic disruption, or sudden illness. If the Provider must cancel the visit, priority will be given to rescheduling.
Article 7: Emergency Response
If any abnormal physical or mental condition arises for the mother or baby during the Service, the Care Provider will offer appropriate advice and encourage medical consultation if necessary. In emergencies, the Care Provider may contact emergency services with the consent of the User or cohabiting family members (or afterward if immediate consent is not possible).
All expenses related to medical consultations or emergency transport are the User’s responsibility.
Article 8: Prohibited Acts
Users must not engage in the following:
- Verbal abuse, harassment, or dangerous acts toward the Care Provider
- Actions that interfere with the operation of the Service or false declarations
- Use of the Service for commercial or unauthorized purposes
- Acts in violation of laws or public order and morals
- Any behavior deemed inappropriate by the Provider
- Recording or filming without the Care Provider’s consent
Article 9: Disclaimer and Limitation of Liability
The Provider will offer the Service with reasonable care and attention; however, outcomes may vary depending on individual circumstances of the mother and baby. Except in cases of intentional misconduct or gross negligence by the Provider, liability shall be limited to the amount of the service fee for the affected visit.
The Provider is not liable for damages resulting from decisions or actions by affiliated medical institutions beyond its control.
Article 10: Personal Information
The handling of personal information shall follow the Provider’s separate Privacy Policy. Users must review and agree to this policy before using the Service.
Article 11: Termination of Contract
The Provider may terminate the contract with notice if the User breaches these Terms or if the Service is reasonably deemed difficult to provide. If termination results in damage to the Provider, the User shall be liable for compensation.
Article 12: Changes to the Terms
The Provider may revise these Terms as necessary. Major changes will be communicated via the Provider’s website or other means.
Article 13: Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. In case of disputes, the court with jurisdiction over the Provider’s location shall be the exclusive court of first instance.
